House Bill 444 Seeks to Reform HOAs

A new bill, House Bill 444, introduced in the North Carolina General Assembly on March 18, 2025, aims to reform homeowners' associations by enhancing homeowner rights, financial transparency, and limiting HOA powers. The bill, introduced by Representative Liu, seeks to address concerns regarding excessive fines, aggressive enforcement, and opaque financial practices. Key proposals include capping fines at $2,500, prohibiting nonjudicial foreclosures for unpaid penalties, and mandating mediation before legal action. Other provisions include restricting retroactive rule changes, regulating HOA management contracts, and increasing financial transparency by requiring homeowners to receive financial statements and vote on significant budget increases.

The bill has garnered both support and opposition. Proponents argue that it will protect homeowners from overreach by HOAs and provide a more transparent and fair process, especially regarding fines and legal actions. However, opponents express concerns that the bill could undermine HOAs' ability to maintain community standards and lead to higher dues if associations struggle to enforce assessments. The bill is currently under review and will likely be debated in committee before being voted on in the North Carolina House.
